Terms and Conditions

Effective Date: October 13, 2026

Welcome to Townflare Creative. These Terms and Conditions govern your access to and use of townflare.com, all Townflare-operated town-specific websites and subdomains, and the products and services offered through those websites.

By accessing our websites, creating an account, placing an order, or using our services, you agree to these Terms and Conditions. If you do not agree, please do not use our websites or services.

1. About Townflare Creative

Townflare Creative is a Massachusetts sole proprietorship based in Woburn, Massachusetts.

Townflare provides custom apparel, personalized products, gifts, promotional merchandise, and online storefronts for individuals, businesses, schools, sports teams, community groups, and other organizations.

These Terms apply to Townflare-operated websites, including town-specific online stores and other storefronts operated through our website network. Additional terms may apply to particular products, promotions, fundraisers, or independently managed storefronts. Where additional terms apply, they will be provided as appropriate.

2. Eligibility and Website Use

By using our websites, you represent that you are legally able to enter into a binding agreement or have the authorization of a parent, guardian, or other legally authorized representative where required.

You agree not to:

  • Use our websites for unlawful purposes.
  • Submit false, misleading, or fraudulent order information.
  • Interfere with website operations, security, or other users’ access.
  • Attempt to gain unauthorized access to accounts, systems, or customer information.
  • Upload malicious software or content that could damage our websites or systems.
  • Use our websites to infringe the rights of others.

We reserve the right to restrict or suspend access where reasonably necessary to protect our business, customers, or website security, subject to applicable law.

3. Products and Product Descriptions

We make reasonable efforts to provide accurate product descriptions, photographs, prices, sizing information, colors, and other details.

However, actual products may vary slightly from website images because of differences in displays, lighting, materials, garment batches, printing processes, and production methods.

For custom apparel and printed products, minor variations in color, placement, texture, and finish may occur. We will make reasonable efforts to produce items consistent with the applicable order specifications.

Product images and mockups are intended to illustrate the product and design. They may not represent every detail of the finished item.

Nothing in this section limits your rights concerning products that are defective, materially misrepresented, or otherwise fail to conform to the applicable order.

4. Orders and Order Acceptance

When you place an order through a Townflare website, you agree to provide accurate and complete information, including contact details, shipping addresses, product selections, sizes, colors, and customization instructions.

Submitting an order constitutes an offer to purchase the selected products. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance.

We reserve the right to refuse, cancel, or correct an order where legally permitted, including in cases involving suspected fraud, pricing errors, unavailable products, technical errors, or incomplete information.

If we cancel an order after payment has been collected, we will provide an appropriate refund as required by law.

We may contact you if additional information, artwork approval, or clarification is necessary before production can begin.

5. Pricing, Taxes, and Payments

Prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotions, and product availability may change. Any change will not alter an order that has already been accepted, except where a correction or adjustment is permitted by law and appropriately communicated.

Applicable sales taxes and shipping or delivery charges will be displayed during checkout where required.

Townflare uses Square to process payments. Payment transactions are subject to the applicable payment provider’s terms and security practices.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Orders may not enter production until payment has been successfully processed and any required order details or approvals have been received.

6. Custom Products and Personalized Orders

Townflare creates custom apparel, gifts, printed merchandise, promotional products, and other personalized items.

Custom products may include, but are not limited to:

  • Custom T-shirts, hoodies, sweatshirts, and other apparel.
  • DTF-printed and sublimated products.
  • Mugs, tumblers, accessories, and personalized gifts.
  • Products featuring customer-supplied logos, photographs, artwork, or text.
  • Products made for schools, teams, businesses, events, and organizations.

Because custom products are made or personalized for a particular customer, they are generally not eligible for return or refund simply because the customer changes their mind, orders the wrong size, dislikes an approved design, or no longer wants the item.

This restriction does not apply where a product is defective, incorrectly produced, materially different from the accepted order, or where a refund, replacement, or other remedy is required by law.

Customers should carefully review all selections and specifications before submitting an order.

7. Customer Artwork and Approval Responsibilities

Customers are responsible for reviewing and approving the information and materials submitted with their orders.

This includes, where applicable:

  • Spelling, names, numbers, dates, and other text.
  • Garment sizes, colors, styles, and quantities.
  • Artwork, logos, photographs, and design files.
  • Placement, layout, and personalization instructions.
  • Final proofs or mockups when provided for review.

Customers are responsible for errors in information or artwork they supply or approve, subject to applicable law and any separate written agreement.

If Townflare makes an error during production or produces an item that materially differs from the accepted order, please contact us so we can review the issue and determine an appropriate remedy.

A customer’s approval does not waive legal rights relating to defective or non-conforming merchandise.

8. Intellectual Property and Customer-Submitted Materials

Townflare retains its rights in its own branding, website content, graphics, original designs, photographs, product descriptions, and other materials, except where rights belong to another party.

You may not reproduce, distribute, modify, or commercially exploit Townflare-owned content without permission, except as permitted by law.

When submitting artwork, logos, photographs, text, or other materials, you represent that you own the materials or have permission to use them for the intended purpose.

You agree not to submit materials that infringe another person’s intellectual property, privacy, publicity, or other legal rights, or that are otherwise unlawful.

By submitting materials for an order, you grant Townflare permission to use, reproduce, modify as reasonably necessary for production, and transmit those materials to service providers as needed to fulfill your order.

This permission is limited to fulfilling the requested services and related necessary business operations. It does not automatically grant Townflare permission to use your artwork or photographs for unrelated advertising or public promotion.

We may decline to produce materials that we reasonably believe infringe another party’s rights or violate applicable law.

9. Returns and Refunds

Townflare offers a 14-day return policy for eligible non-custom products.

Non-Custom Products: 14-Day Returns

Non-custom products may be returned within 14 calendar days of delivery, provided they are in good, sellable condition.

To qualify for a return, the item must generally be:

  • Unused and unworn.
  • Unwashed and undamaged.
  • In its original condition, with original packaging and tags where applicable.
  • Free of stains, odors, pet hair, alterations, or other conditions that prevent resale.

Items that have been used, worn, washed, damaged, altered, or otherwise rendered unsellable may not qualify for a standard change-of-mind return.

Customers must contact Townflare before returning an item to receive return instructions. Please include your order number and a description of the item you wish to return.

The 14-day return period is intended for eligible, non-custom products that customers no longer want or that do not meet their preferences. It does not limit rights relating to defective or incorrectly supplied merchandise.

Custom and Personalized Products

Custom or personalized products are generally final sale and are not eligible for change-of-mind returns.

However, if a custom product is defective, incorrectly produced, materially inconsistent with the accepted order, or otherwise subject to a remedy under applicable law, please contact us. We will review the circumstances and provide an appropriate remedy as required by law.

Defective, Damaged, or Incorrect Products

If an item arrives damaged, defective, or different from what was ordered, contact us as soon as reasonably possible.

Please provide your order number, a description of the problem, and photographs where helpful.

Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement, or refund.

Refund Processing

Approved refunds will generally be issued to the original payment method where practicable and legally appropriate. Processing times may depend on the payment provider or financial institution.

Any legally required refund will be provided within the applicable timeframe.

Shipping charges, return shipping costs, and other charges will be handled in accordance with the circumstances of the return and applicable law. We will communicate any applicable return shipping arrangements when the return is authorized.

Our return policy will be displayed or made available clearly before purchase. Nothing in this section limits rights that cannot legally be waived.

10. Order Cancellations

Customers may request cancellation of an order before production begins.

Because Townflare may begin purchasing materials, preparing artwork, printing, or otherwise producing an order shortly after it is placed, cancellation cannot be guaranteed once production has started.

To request a cancellation, contact us promptly and provide your order number.

If production has already begun, we may be unable to cancel the order, particularly for custom or personalized items, except where cancellation or a refund is required by law.

If Townflare cancels an order or cannot fulfill it, we will provide any refund required by law.

11. Shipping and Delivery

Townflare may offer shipping through UPS, USPS, FedEx, ShipStation, or other shipping and fulfillment services, depending on the order and available options.

Shipping methods, charges, and estimated delivery dates will be provided during checkout or through applicable order communications.

Delivery dates are estimates unless expressly stated otherwise. Delays may occur due to carrier disruptions, weather, production requirements, address issues, holidays, or other circumstances.

We will make reasonable efforts to communicate significant fulfillment delays. If we cannot ship within the promised timeframe, or within the applicable legally required period where no timeframe was promised, we will provide the notice, cancellation option, and refund required by law.

Customers are responsible for providing an accurate and complete shipping address. Please contact us promptly if you discover an address error.

If your order is delayed, appears lost, arrives damaged, or is marked delivered but cannot be located, contact Townflare so we can review the situation and determine appropriate next steps.

Nothing in this section excludes any rights or remedies available under applicable shipping, payment, or consumer protection laws.

12. Local Pickup and Local Delivery

Certain Townflare websites may offer local pickup or local delivery.

Availability, instructions, and any applicable charges will be provided during checkout or in order communications.

Customers selecting pickup should follow the instructions provided for their specific order or storefront.

For local delivery, customers are responsible for providing accurate delivery information and any necessary instructions.

If you need assistance collecting an order, please contact us in advance. We will make reasonable efforts to assist where possible.

Pickup and delivery arrangements may vary by location and storefront.

13. Town-Specific Stores and Customer-Created Stores

Townflare operates multiple town-specific websites and storefronts. We also offer opportunities for customers, businesses, schools, teams, and organizations to establish or participate in Townflare stores.

Depending on the arrangement, Townflare may manage the storefront, product listings, payments, production, and fulfillment, or may work with a participating organization that has specific responsibilities.

The applicable store arrangement, including any fundraising terms, ordering deadlines, commissions, revenue-sharing arrangements, or other special conditions, must be communicated separately where relevant.

Customers creating or participating in a store are responsible for providing accurate information, authorized branding, and appropriate product and design details.

No commission, fundraising percentage, payment schedule, or other financial arrangement is promised by these general Terms unless separately agreed in writing.

Townflare may suspend or remove a storefront where reasonably necessary because of inactivity, unauthorized content, legal concerns, operational requirements, or a breach of applicable store-specific terms.

14. Customer Accounts and Security

Customers may create accounts to manage orders, save information, and access available website features. Guest checkout may also be available.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account, subject to applicable law.

Please notify us if you suspect unauthorized access to your account.

We may suspend or restrict accounts where reasonably necessary to address suspected fraud, security issues, misuse, or violations of these Terms.

Account closure does not eliminate outstanding payment obligations or legal recordkeeping requirements. Personal information will be handled according to our Privacy Policy and applicable law.

15. Promotions, Discounts, and Special Offers

Promotions, discounts, coupons, and special offers may be subject to additional conditions, expiration dates, eligibility requirements, or product exclusions.

Unless expressly stated otherwise, promotional offers cannot be combined or applied retroactively to completed purchases.

If an offer is canceled or modified, we will honor obligations that have already arisen under applicable law.

16. Third-Party Services and Links

Our websites may connect to or rely on third-party services, including payment processors, shipping providers, analytics services, and external websites.

Those services may be subject to separate terms and privacy policies.

Townflare is not responsible for the independent content or practices of third-party websites or services, except to the extent responsibility cannot legally be excluded.

17. Website Availability and Technical Errors

We strive to maintain accurate and reliable websites but cannot guarantee uninterrupted access or that all website content will always be error-free.

Temporary interruptions may occur because of maintenance, hosting issues, software updates, technical failures, or circumstances beyond our reasonable control.

If a technical error affects an order, price, payment, or product listing, please contact us. We will review the issue and take appropriate corrective action consistent with applicable law.

18. Warranties and Consumer Rights

Products are subject to any express warranties provided with the product and any implied warranties or other protections that apply under law.

Nothing in these Terms is intended to exclude, restrict, or waive consumer rights or remedies that cannot legally be excluded, including applicable rights concerning defective goods, non-conforming products, or unfair or deceptive practices.

Where a limitation or disclaimer is permitted by law, it will be applied only to the extent legally permitted.

19. Limitation of Liability

To the extent permitted by applicable law, Townflare will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the use of our websites or products where such damages may lawfully be excluded.

Nothing in these Terms limits liability for matters that cannot legally be limited, including applicable statutory rights and remedies.

Townflare does not exclude responsibility for its own obligations where doing so would violate applicable law.

This section must be interpreted consistently with mandatory consumer protection laws and any applicable warranties.

20. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising directly from your unlawful use of our websites or from artwork or materials you submit that infringe another party’s rights.

This provision does not require you to indemnify Townflare for losses caused by Townflare’s own unlawful conduct or other matters for which indemnification cannot legally be required.

21. Privacy

Your use of our websites is also subject to the Townflare Creative Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

You can review the policy at:

Please locate the Privacy Policy link in the website footer.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, products, services, or legal obligations.

The updated version will be posted on our websites with a revised effective date.

Changes will apply as permitted by law. Any rights or obligations relating to an existing order will be handled consistently with applicable law and any separate agreement governing that order.

23. Governing Law and Disputes

These Terms are intended to be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where another law must apply.

Any dispute will be handled in a court or other forum with appropriate jurisdiction, subject to applicable consumer protection laws and any mandatory rights concerning venue or dispute resolution.

Nothing in this section prevents a customer from exercising rights available under applicable law.

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent legally permitted.

Any invalid or unenforceable provision will be interpreted or limited only as necessary to comply with applicable law.

25. Entire Agreement

These Terms, together with the applicable Privacy Policy and any separately communicated store-specific or order-specific terms, govern your use of Townflare’s websites and services.

Where a separate written agreement applies to a particular store, custom order, or business arrangement, its terms will govern the matters it specifically addresses, subject to applicable law.
